341 Meeting Information for Debtors


The 341 meeting is a legal requirement and hearings are conducted in Tucson and Florence.  You and your attorney must attend, but it is optional for creditors.  If you do not know your meeting date and time, please contact your attorney.

During the 341 meeting, the Trustee will:

(1) Put you under oath.

(2) Confirm the accuracy of your petition, statements and schedules filed in the bankruptcy case.

(3) Ask questions required by law.

(4) Briefly review the plan payment schedule proposed in your plan.

(5) Ask any specific questions she has about your financial affairs.  Creditors will then be given the opportunity to question you.  341 meetings are recorded so all answers must be answered audibly.

The Trustee must confirm your identification before she can conclude your 341 Meeting, so you must bring:  
- Valid government issued photo identification (ex: Driver’s license, Passport, or Resident Alien Card)
- ORIGINAL document evidencing social security number
  (ex: Social Security Card (not a photo), Insurance Card IF it displays full SSN or a W-2)
- Tax returns and Drivers licenses are NOT proof of SSN for this purpose

If you do not bring BOTH forms of identification, you may be required to attend a second time

You must provide the following documents at Least 7 Days Prior to the 341 Meeting:
- Bankruptcy Questionnaire
- Two recent and consecutive post-petition paystubs
- Copies of your two most recently filed personal income tax returns
- If you pay child support or alimony, the name and address of the recipient (not the clearinghouse)
